Terms and Conditions - iknowpc
These Terms and Conditions ("Agreement") govern the relationship between iknowpc, hereinafter referred to as "the Contractor," and the Client, hereinafter referred to as "the Customer." By engaging the services of iknowpc, the Customer agrees to be bound by the following terms and conditions:
1. Scope of Work: iknowpc specializes in providing low voltage contracting and AV home automation services. The scope of work shall be detailed in a separate agreement or contract signed by both parties.
2. Equipment Warranty: a. iknowpc shall install equipment supplied by reputable manufacturers and suppliers. The warranty of the equipment installed shall be subject to the terms and conditions set forth by the respective manufacturer.
b. iknowpc shall not be held responsible for any defects, malfunctions, or damages arising from the use of the equipment. Any claims for warranty shall be addressed directly with the manufacturer or supplier.
3. Payments: a. The Customer agrees to make payments to iknowpc as per the payment terms outlined in the separate agreement or contract.
b. In the event of delayed or non-payment, iknowpc reserves the right to suspend or terminate the services until payment is received in full.
4. Delays: a. iknowpc shall make every effort to complete the work within the agreed-upon timeframe. However, iknowpc shall not be held liable for delays caused by unforeseen circumstances beyond their control, including but not limited to supplier delays, weather conditions, or acts of nature.
b. In the event of any delays, iknowpc shall promptly inform the Customer and provide an updated timeline for completion.
5. Indemnification: a. The Customer agrees to indemnify and hold iknowpc harmless from any claims, liabilities, damages, or expenses arising out of or related to the services provided.
b. The Customer shall be solely responsible for ensuring compliance with any applicable laws, regulations, or permits related to the installation of low voltage systems or home automation equipment.
6. Limitation of Liability: a. iknowpc shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the services provided or the use of the equipment.
b. The total liability of iknowpc, if proven liable, shall not exceed the total amount paid by the Customer for the services rendered.
7. Termination: a. Either party may terminate the agreement by providing written notice to the other party in case of a material breach of the terms of this Agreement.
b. Upon termination, the Customer shall pay for all services rendered up to the date of termination and any outstanding fees or expenses incurred.
8. Confidentiality: Both parties agree to keep all information exchanged during the course of the engagement confidential and shall not disclose it to any third party without prior written consent.
9. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of [Your Country/State]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Your Jurisdiction].
10. Amendments: iknowpc reserves the right to amend these terms and conditions from time to time. The Customer will be notified of any changes, and the revised terms will be applicable to all future engagements.
By engaging the services of iknowpc, the Customer acknowledges that they have read, understood, and agreed to the above terms and conditions.
